Terms and Conditions – Mahendra Cab Dehradun

QUOTES AND PAYMENT

The customer shall pay the amount of the following:

• The fare according to taxi meter or according to fixed fare agreed upon, whichever is applicable,
• The toll charges will be payable by the customer as applicable only while crossing the toll post
• Parking charges (where applicable)
• Additional night surcharge (where applicable )
• Any tax or charge currently levied or hereafter imposed by the statute or payable for the purpose of using the taxi services.

VARIATIONS

• The Customer accepts and agrees that the provision of services by mahendracab.com is provided solely for the risk of the customer and that mahendracab.com disclaims any kind of representations or warranties, whether express or implied as to condition, quality, suitability, merchantability and fitness for any purpose are hereby excluded to the fullest extent permitted by law.

Without prejudice to the aforementioned, mahendracab.com makes no representation and warranty that:

•   The service will meet your requirements,
•   The service will be uninterrupted, timely, secure, or error-free.

LIABILITY

• mahendracab.com will in no way be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of taxi service offered by mahendracab.com or due to the failure of mahendracab.com to provide services to the Customer for any reason whatsoever including but not limited to the Customer’s non-compliance with the services’ recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of mahendracab.com or any person or any organization involved in the above-mentioned systems.
• mahendracab.com shall have no liability to the Customer for any direct or indirect loss or damage suffered by the Customer arising out of any failure by mahendracab.com to make the taxi available to the Customer on time even if mahendracab.com had committed itself to making the taxi available to the Customer at such time or even if the Customer had advised mahendracab.com of the possibility that such loss or damage would occur in the event that the taxi is not made available or is not made available before the stipulated time.
• Customer shall indemnify mahendracab.com from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions and proceedings which mahendracab.com may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of the Services by the Customer and shall pay such sums on demand.

GENERAL

• All calls made to our call center are recorded by us for quality and training purposes.
• All vehicles registered with mahendracab.com are continuously tracked using GPS for security reasons only.
• mahendracab.com shall be entitled at any time without giving any reason or prior notice to terminate the booking of taxis done by the Customer.
• mahendracab.com will encourage all its customers to take full responsibility of his/her items. In case of loss of items inside the cabs during the journey, mahendracab.com will try to locate the items but is not responsible for the same in case of loss or damage to the same.
• If the Customer leaves any goods in the taxi or has any complaint in respect of the services or the use of the taxi, the Customer has to inform mahendracab.com of the same in writing within 24 hours of using the taxi.
• Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
• All matters arising out of or related to use of this website shall be governed by and construed in accordance with the laws of India.

DATA PROTECTION

• mahendracab.com is granted the right to use location-based information provided by any of the telecommunication companies, for and during the use of the mobile phone for the purpose of making a taxi booking by the Customer. Location-based information will be used solely for the facilitation and enhancement of the possibility of finding a taxi for the Customer.
• mahendracab.com would be entitled to use of customer contact information for our direct marketing purposes. We may issue regular SMS and Email updations to the registered mobile numbers and email IDs which are registered with us.
• mahendracab.com does not warrant that this site, its servers, or e-mail sent from mahendracab.com are free of viruses or other harmful components. mahendracab.com will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
